Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ExpatTel service (the "Service"), operated by [Legal Entity Name] ("ExpatTel", "we", "us"). By creating an account, porting a number to us, or paying for a subscription, you agree to be bound by these Terms.

1. The Service

ExpatTel is a number-retention service. We accept the port-in of eligible mobile numbers from partner countries, and deliver inbound voicemails and SMS to you via our web portal, mobile apps, and email. ExpatTel is not a telephony service — you cannot make outbound calls or send outbound SMS through the Service, nor can you receive live inbound calls (all calls go to voicemail).

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract to use ExpatTel. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at security@expat.tel if you suspect unauthorised access.

6. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service depends on third parties (carriers, cloud providers) whose availability we cannot fully control. We are not liable for outages caused by these third parties, force majeure events, or scheduled maintenance.

7. Intellectual property

ExpatTel and its licensors own all rights in the Service, including the software, brand, and content (excluding your own voicemails and messages). We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

8. Your data

Our handling of your personal data is described in our Privacy Policy. You retain ownership of the content of your voicemails and messages; we act as a processor for that content.

9. Warranty disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. This does not exclude any statutory consumer rights you may have under Australian Consumer Law, the UK Consumer Rights Act 2015, or equivalent legislation in your jurisdiction.

10. Limitation of liability

To the maximum extent permitted by law, ExpatTel's aggregate liability to you for any claim arising from these Terms or the Service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.

Nothing in these Terms excludes liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Termination

You may terminate your subscription at any time from the portal. We may terminate or suspend your account with reasonable notice if you breach these Terms, if your account is inactive for more than 12 months, or if we discontinue the Service. On termination we may return your number to the local number pool unless you request a port-out to another carrier in time.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email at least 30 days before they take effect. If you disagree with the changes, you may terminate your subscription; continued use after the effective date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of [Governing Jurisdiction]. Any dispute will be resolved in the courts of that jurisdiction, save that we may bring proceedings to protect our intellectual property in any competent court.
